Two parents are suing the Carmel Central School District, claiming a reading teacher bullied their son in the first and second grades.

The lawsuit in state Supreme Court by Elizabeth and Neftali Rivera charges that when their son, Neftali Jr., attended class at the Kent Elementary School, reading specialist Karen Baryshyan “berated him, was rude to him, disrespectful to him, did not allow him to express himself, singled him out, bullied him, treated him differently than other children, intimidated him and ultimately assaulted him” by poking him forcefully in the chest.

The Riveras’ lawyer, Rick Cowle of Carmel, was unavailable for comment Wednesday.

Baryshyan is a former member of the Board of Education in the Carmel district, serving in the late 1990s before losing a re-election bid in 2001. Reached by phone Wednesday evening, Baryshyan declined to comment in detail.

“I have a lawyer, because I was not the teacher of record, and that’s all I have to say,” she said.

The Riveras are seeking more than $1 million in damages in the case, filed June 27. They could not be reached Wednesday for comment.

The school district has denied the charges.

According to the lawsuit, Neftali Rivera Jr. began taking special reading classes at the age of 6 in the first grade, twice a week, and was later assigned to Baryshyan’s reading sessions as a 7-year-old in the second grade. The boy began to express fear of going to school and did not improve his reading skills due to the difficulties he experienced in the reading classes, the lawsuit claims.

The lawsuit alleges Baryshyan repeatedly yelled at the youngster and acted in an unprofessional manner. They claim that their son, who is Hispanic, was treated differently because of his ethnicity.

The lawsuit says a meeting with the school’s principal, Deborah Weisel, was held in October 2012 but claims the administration did nothing to address the situation.

The boy was eventually put under the direction of another reading specialist in 2012 and “is now doing quite well in his reading class,” the lawsuit says. It faults the school district, claiming it failed to prevent the “continued mistreatment” of the boy.

In legal papers filed recently, the school district says the Riveras did not suffer “any pain or suffering, emotional, psychological or physical whatsoever as a result of actions taken by defendants.” It maintains the actions taken by educators “were in good faith and for legitimate nondiscriminatory reasons.”

If this teacher or school was negligent in any way they should suffer financially in order to help keep this from happening again in the future.

Even thinking that a person "an adult" would bully a 1st or 2nd grader - 6 or 7 years old doesn't even register to me - who would actually do that?
