ST. PETERSBURG (FOX 13) - The Pinellas School Board is being sued for injuries allegedly inflicted in a bullying incident at Largo Middle School in February 2012. The petition only identifies the victim by the initials "E.D." and his mother by the initials "R.D." and has not yet been served on the school system.

It says the boy was kicked by another student so hard one of his testicles was removed.

This allegedly happened after the victim was bullied in the gymnasium area of the school while a substitute teacher played basketball with other students. The lawsuit says the injured boy has Asperger's Syndrome, which is a form of autism, and that behavioral issues with other students were well-documented.

"The school board knew what they needed to provide, they knew what his problems were, and they basically did not provide what he needed," Orlando attorney Jeremy Weinsier told FOX 13 News.

The lawsuit refers to state laws that require education programs that are tailored to an individual student's special needs.

The Pinellas school system is on a summer schedule and nobody was available to answer questions. However, historically, governmental entities do not comment on pending litigation. Weinsier provided a notice of the initial complaint filed with the school system dated March 10, 2012.

Friday, he said "They've completely denied any responsibility for the incident."

The lawsuit claims damages in excess of $15,000, but the attorney said that is not the mother's primary motivation.

"Her biggest concern here is that this doesn't happen to other students," Weinsier said.

What a terrible thing to happen to a young boy. I hope the school takes some responsibility and rethinks their anti-bullying policy.

Only fifteen thousand dollars for an accident like that. Sounds very low to me. Schools need to keep a better eye on our kids today.
