Amazing how fast people will listen these days when threatened with a lawsuit. It seems like everyone barks louder than they bite because they all spout off comments about how they know their rights until they are presented with a cease and desist then they keep that big yapper quiet. Lawyers are like the grim reaper to some people and they beg not to be dragged into court so they comply with whatever the paper tells them to do.

Well I think that you are basically telling them that you have a legitimate case against them and will follow through if you do not stop what you are doing so yes if they dont take it seriously it will be a dark mark on the case when they are in front of a judge.

These dont cost a lot of money and they will do the trick almost every time. When you lawyer up and take it serious people will back down from fear of prosecution.

I've heard a lot of C&D's way back, this happens just about everywhere else. I don't think it would be applicable on facebook but there are some who's able to get away with it and there are some who is just so hard-headed that they don't care about a C&D letter or notice.

This will save you a lot of time and money too because even if they are hard headed and ignore it then the judge will be upset with them already because they couldnt handle it on their own terms.
